latest H1B quota usage

By June 24, 2005, the quota usage is as follows:

about 8300 out of 20000 (2005's quota for master+ degree holders)
about 5500 out of 20000 (2006's quota for master+ degree holders)
about 27300 out of 65000 (2006's normal quota for general purpose)

But does anyone know the MOST recent updates about these quota usage?

Is it correct, i understand that there are still 37700 Visas available for 2006 ???

Thanks, Strotti, I also just got the info/update on H1B.

however, do you know will the unused 9000 from FY2005's quota for advanced degree holders transferred to FY2006?

As on 4th August 2005, the H1 QUOTA IS

Cases Received 51939 as on 04.08.2005
Cases Received 27326 as on 30.06.2005
Cases Approved 22383 as on 04.08.2005
Cases Pending 29556 as on 04.08.2005

Cases Pending before 30.06.2005 is 4943
Cases Pending after 30.06.2005 is 24613

So, if you have applied in or before June then you are in 4943 cases.

H1 Fees

If we mail out a H1B application against FY 2006 quota and if in the mean time USCIS announces that the quota has been reached and our application is in transit by mail will they return the application and fees or will they encash the check and then reject the H1B later on?

I am forwarding you a quote from the press release that USCIS published once the FY-2005 Quota was reached. This has the information on how they process things that are in the mail:

THIS IS NOT A PRESS RELEASE FOR FY-2006 WHICH WILL START OCTOBER 1, 2005. DON'T PANIC, THERE ARE STILL SLOTS FOR FY-2006, AND THE NEW 20,000 QUOTA SET FORTH FOR MASTER'S DEGREE STUDENTS.

"For the remainder of FY 2005, USCIS will follow the procedures set forth in the notice published on
February 25, 2004 in the Federal Register at 69 FR 8675 to address the cap reached during FY 2004. Those
procedures include:
· USCIS will process all petitions filed for first-time employment received by the end of business today.
· USCIS will return all petitions for first-time employment subject to the annual cap received after the end
of business today.
· Returned petitions will be accompanied by the filing fee.
· Petitioners may re-submit their petitions when H-1B visas become available for FY 2006.
· The earliest date a petitioner may file a petition requesting FY 2006 H-1B employment with an
employment start date of October 1, 2005, would be April 1, 2005."

first of all thanks for that latest update...

however can u please cite the source of the data quoted....???????????

8/4/2005 - is it 4th august 2005 or 8th april 2005...????????

also does it mean that as on 8/4/2005 (say) there are still 58,200 - 51,939 =
6261 applications the USCIS will recieve and rest they will reject for 2006 quota (assuming of course all 6261 are accepted and none is pending or rejected...)..???????????????

pleas eclarify in details...

New viasa are available for FY 2007 from Apr 2006. with start date Oct 2006

Does the above mean that say any employer (say my sponsorer) who wishes to hire me can make actually H1B application petition on my behalf to US authorities from 1.4.2006 and NOT before (of course for quota 2007)........??????????????

2. "with start date Oct 2006"

Does the above mean that assuming my US sponsorer /cum potential employer has applied for my h1b visa (as per point 1 above)...actual processing and granting process shall start only from 1.10.2006 and NOT before that.

I would really really urge someone to kindly confirm that my understanding above is correct and in case NOT a hint as to where it is wrong.

Rest all is good from my side as ALMIGHTY's grace is there....

It means that the emplyer can file the petition on or after April 1, 2006. USCIS will process the petition on receipt but the authorized start date for employment cannot be before the start of fiscal year 2007 (October 1, 2006). You will somehow need to maintain your status until October 1, 2006.

This is what this whole fiasco looked like from my perspective:

On August 11. 2005, there was an AILA posting that stated that the H-1B numbers were being used rapidly and probably would not last much longer. The posting provided a link to the USCIS website that stated that as of August 4, 2005, there were approximately 6,500 H-1Bs left for Fiscal Year 2006. Late in the day (after normal business hours) on August 11, 2005, AILA sent out an emergency email stating that they had "reason to believe" that the cap would soon be exhausted and may already had been reached. The next morning, on August 12, 2005, USCIS formally announced that the 2006 H-1B quota had been hit as of August 10, 2005!

The mathematics of this is extremely problematic. I have been doing H-1Bs for nearly a decade and I have never seen this happen. There was no notice whatsoever and the official notices that were out were misleading (as you can see from the references above).
