I have three questions:

1. If a TN holder gets laid off, how soon he has to leave the U.S.? I don't find a certain answer here.

2. How to claim unemployment insurance as a TN holder before he has to leave the U.S.?

3. Once a TN holder who gets laid off and returns back to Canada, how soon could he re-enters U.S. again as a tourist? If he still wants to find a job in the U.S. in the near future.

1. Legally you have to leave the day you are laid off. Realistically you about about 10 days.

2. You have to return to Canada in order to claim US Employment Insurance. You must be "legally able to accept work" and you cannot do that in the US without a TN.

3. If you leave and have not been denied entry into the US then probably the next week?

I am not a lawyer nor do I play one on TV these answers are from my knowledge and experience on being on 15 TN's over an 11 yr period.

3. Remember 3 things: You will be entering as a tourist, which means carrying proof of residence outside US, so more than a week will be needed to establish (DL, plates, lease, utilities, etc).

Second, as a toursist, you can't just waltz into US looking for work; you will be turned away, entry on tourst status is for toursism, the POE will know you were on TN, have no job, and will be on the job hunt.

lastly, in order to keep qualifying for EI -- especially if paid by EI rather than your state UI program, you need to remain in canada, or reportt that you are leaving and forfeit that week's dole.
 
Contractor under TN, client wont renew after contract is up

Hi,

My contract with my client will be expired in Mar 2010, can I collect UI from US or Canada?

I am working for my contract house and I got pay per hr base. If my client wont renew but I think I am still employed with my contract house but no pay. I have two choice, either stay and find a new job or move back to Canada.

You need to be working to be in valid TN status. So, once you stop working for one client, you need to go to another client, fins a job on your own 9and get a new TN) or leave.

You would need to go back to canada to collect UI.
