I have 2 more years on H1-B. My labor petition has been filed last year and based on current processing times, it will be processed some time next year.

I would like to know how I could protect myself from not having to leave the US after H1-B expiry, in case there is any problem with my labor petition within 365 days from H1-B expiration.

Thanks,

The Labor petition is the only way to preserve your H1.
However you can change to B visa and if labor gets approved after you change to B visa, can file 140 , 485 and 765 concurrently and start working again using EAD. If labor is denied, you will have to leave US at the end of H1 and to start working again in H1 in US have to wait outside US for one whole continuos year.
