L2 Visa issues

Hi:

I came to US on L1 B, my wife and kid came as dependents with me, when we reached port of entry , the immigration officer at the port of entry told, that the US Chennai Consulate gave L1 visa to my wife , instead of giving L2 Visa, finally after consulting with other officer, they cancelled the Visa , and gave Waiver Visa to her, and gave I 94 to her. As they cancelled the Visa, she cant apply get Driver Licence and she even cant apply for EAD to work , also if she want to go to India, as Visa is cancelled , she may have to go to Visa again.

Need some advice on how to go further , as she is struck here.

She is in VWP(Visa Waiver Program)? Its valid for only 90 days. Since its a mistake from immigration officer, guess it should be rectified without any fee and much of delay.
