L2 Visa issues

Sir,

Myself , Spouse and child came to US in L1 blanket petition of my company that expired on Jan 2006 and also at at entry time we all got I-94 till that date only. My company applied for new petition and got approval and after that they applied for our I-94 and we all got I-94 renewed till Jan 2008.

Since my wife is in L2 status, she got the EAD and also got a Job in US. This company will also do H1 for her.

My question is

1) If in case I go back to India before October (my wife company informed that her H1 will get approval by that time only) can she work in US till her H1 got approval or will she and my child be out of status?

2) I have also applied for new H1. Can I continue work on L1 even after my H1 is approved?.

1) if "go back to India" means you permanently go back to your country and not employed by L1 company, i believe your L1 is not valid, thus your wife's L2 is not valid either. Then EAD is not valid.
2) You can continue working for L1 company after your H1 approval, but you can not work for L1 company after H1 start date IF you filed change of status.
if you did not file change of status, you can work for L1 company as long as you want.
