L2 Visa - EAD Renewal

Hi,

My wife is working on the EAD based on the L2, which is about to expire.

She has applied for extension of her EAD. I had the following queries :
1. Can she continue to work even while her EAD has expired and she has applied for a new one ?
2. Can she be on unpaid vacation when her EAD expires. Then once her new EAD comes then she can join duty back to the same employer.

It would be nice if someone could please answer these queries.

Thanks in advance.

As per this website : https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203500!opendocument
L2-visa holders do not need to apply for EAD.
Please let me know if this is true.

Hi,

In this website :
https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203500!opendocument

See section - C, C. Policy - Employment Authorization by Class of Admission, refer to Point 1.
It mentions the following :
"The E-1, E-2, and L-2 spouse is not required to apply to DHS for an EAD card as documentary evidence of work authorization but may choose to do so."

So please let me know that are L2-visa holders required to apply for EAD to continue to work in US or it is not required.

Thanks once again to everyone for responding.

L2 Extension

My husband is on L1 visa. The petition documents are valid until Apr 2008. But his visa stamping was given only for a period of 1 year until Sep 2006. As we had to go to India in 2007, we again reappeared for visa interview with new L1 petition and were granted visa till 2010. I have my earlier L2 EAD which is valid until Apr 2008. Do i have to apply for extension of my EAD. Please advise...

Interesting.
But if I were you, I will get EAD before work. I don't know how much the policy of SSA works to USCIS.
