Hello,

This query is quite urgent. Please reply asap.

I am currently on L2 visa(not working also) in US. I applied for change of status to L2 which got approved and starting date 1st Oct'08.
Now I am travelling back to India on 20th Sept and coming back on 20thOct'08. I am planning to re-enter US with L2(so I get new L2 I94).
After sometime (say by dec'08) I will plan to shift to H1-B. As my recent I-94 will be for L2 - Is it possible get status changed to H1B at that time without going back to India??

Your early repy is very much appreciated.

regards

Yes, you can. You might be asked to prove that the employment still exists for you (particularly, if you are joining quite late after 10/01/2008).

When you enter the US, you are going to be on L2 status and that is after H1 effective date. You have to change the status again to H1 before working under H1 status.

Thanks!

Thanks John and GotPR for you replies.
Do you have any idea how much will it cost to change the status again back to H1-B and processing time?
Also, is it possible to get h1 transfer after coming back on L2 here and without working for h1 sponser employer?

thanks again for earlier replies.

Change of status to H1 costs up to around $2000 depending on the company size.
Transfer shouldn't be a problem.
