Hi Greatguru,

Please help us in this matter.

My wife came to USA on L2 and then converted to H1B, but without stamping. She is working in USA since 1year.
Now recently, we went to Canada for her H1B stamping. They asked her to go to India as it is first time stamping.

She went to India from canada. There she took an emergency appointment in kolkota consulate since we had appointment slots available in earlier dates. But, in Kolkota consulate, they asked her to go to Chennai Consulate. Not sure why they asked to go to Chennai.

She got all documents available and she was never out of status in USA. She graduated from University Campus and have 4years of IT experience in INDIA and then 1 Yr in USA.

We are really tensed now about the stamping in Chennai consulate.

How should we prepare for this Interview and what type of documents they stress upon in this case?

Could you please help us in preparing for this interview.

Any help in this regard is much appreciated.

Thanks
Kiran

No one can prepare you for any kind of interview at consulate, there are no guarantees in consulate. Only thing works is luck and VOs mood. So just be prepared with all documents and go for the interview and try to answer the questions honestly.
Seems like your wife has lot of job experience so it should not be problem proving that you have never been out of status and done nothing illegal.

You should be careful about two things during interview.
1. Your side, make sure your spouse have all the original and authentic document to prove qualificationh/exp. (ofcourse no out of status). Paystub/w2/tax return etc.

2. The sponsering company must be outstanding. (Counsel may require Company photos, her work schedule/nature of job, itenary for 3 years, end client contract etc)

Please be prepared to have those documents before going to interview.

Thank you all for the details.

We have her all original documents like Qualification, experience, W2s, Tax returns, Pay stubs etc.

But the sponsoring company is not an outstanding company. Its a small company with 20 members team. will it create any problem?

Also, the company is doing a sub-contracting in her case. Do we need to have contract details of end client or the company to which they are doing sub contracting?

Please advise.

Chennai Interview Date

Have you got an Emergency Appointment at Chennai? What's the date that you got?

Hello GreatGuru, Please Help!!

I had another question regarding appointment schedule. While taking appointment, which option do we need to select. Is it
A resident of India/Bhutan
or
An Indian citizen resident in USA.

My wife was in USA since July 2004 till Mar 2006. She is in INDIA during April 2006. Which option would best suit her situation?

Also, while filling DS-156, Do I need to mention that her VISA was refused twice. In Canada they gave a letter stating that "we strongly recommend you to go to your home country for VISA". In calcutta they did not give any letter. They just asked her to go to Chennai consulate. In this case, do I need to mention that her VISA was refused twice?

Please advise.

You can select 'Indian Citizen resident in USA'.

Yes, if you have been refused a visa you should put that on your 156 forms. If they find out later it might be a bigger problem.

Guys,

Finally my wife got H1 Stamping done in Chennai.
She didnot take any appointment in chennai. she directly walked to the consulate since her case was 221(g) redirect.
Interview seems to be went well. They just verified her educations certificates, experience letters and pay slips. They didnot ask any questions. Verified above documents and granted VISA.

Thanks for your suggestions.
