L2 EAD Greencard

Hello,

I came to US on L2 visa, i got my EAD in september 2005 and valid upto september 2006. My L2 visa expired in december 2005, i have valid I-94 uptill septamber 2006. Can i apply for greencard. If yes what is the procedure and the various steps which i should follow for applying.

Can you please help me by answering my questions.

YOu can apply for Greencard.. Your sponsor(not you) needs to file LC(labor certificate) unless you are qualified to some category which is not required LC, and then your sponsor(again not you) files I140, and then you(this is you) file I485. You may be able to file I140 and I485 concurrently in some circumstances. So, basically first thing you need to do is finding employer who is willing to sponsor your greencard applications. If you are qualified to National Interest Waiver(NIW), you can file your GC by yourself without sponsor, though NIW is not very common. I do not know which country you were born and which EB category you'll be in , but for some people, current waiting time is quite long.. so be prepared.

When you reach I485, you donot need to maintain your L2 status, but I485 is quite far at
today's climate, so you need to maintain your non-immigrant visa status at least next few years to keep going with GC process in the US.
