L2 EAD and H1 and Green Card issue

I am on L2 Visa, having EAD valid till April'2009.
I joined a X company in April 2007 as permanent employee.
I also applied for H1 visa (to get an independent visa status) in April through Company Y and it is approved.
Now, my current employer (X ) is ready to process my Green Card.
Q: 1 If I go for my Greencard process , what should I answer to company Y who processed my H1 ?
Q2: How long GC process takes if it is filed in PERM in Septermber ? Till I get GC, what would be my visa status ?
