L1B Visa Rejection

Hi,
I had a valid L1B visa from 28th Jan 2004 to 27th Jan 2005.During this period I didn' travel to US.As my visa got expired I again went for re stamping in Chennai Consulate, but this time my visa was rejected under 221(g).The officer asked me to reapply with individual L1 petition..The officer gave me a paper in which the reason given was ""the petitioner has not filed an individual L petition for you"

1)Why was my L1 rejected, when Just a year back the same visa was approved?
2)what is the difference between blanket and individual L1?
3)What is the chance of my individual L1 visa getting rejected ?
4)Can I apply for H1B? Does this rejection have any effect on my future H1B application?
5)which visa should i go for L1 individual or H1b?

2) Individual L-1 have to file the petition in the USCIS first. Once you get the approval you can take appointment and goto the consulate for interview.

Once the L-1 Blanket is approved, the company may transfer people to the U.S. on L-1 visa quickly and on short notice without having to file a separate petition for each employee with the USCIS.
 
Hey, more information regarding your prior L-1 visa is needed to answer your questions.

1) Was the earlier visa obtained under the Blanket petition? If this time you applied for an individual visa, then you needed an approved individual petition. In case this time you reapplied for L-1 visa under the blanket, then you needed a copy of approved Blanket petition with approval notice.

2) Blanket petition is obtained by a company after it satisfies certain conditions. Once the company obtains a blanket approval, it can send its employees directly to the consulate for visa stamping, without filing an individual petition for each employee?

3) Depends upon the documentation in the petition and your interview?
4) Yes. No this won't affect subsequent H-1B?
5) Depends upon your situation and the employer?

L1 B rejected reason failed to establish that he is specialized knowledge worker

Hi

I applied for L1B (specialized category) and went for the interview in chennai consulate. The visa officer asked me only 3 Q's and the interview lasted for less than a minute.

Finally he rejected my visa saying under 221(g) stating I failed to establish that I was a specialized knowledge worker.

He said that indian companies are misusing this category of visa and the laws have changed since June and then he asked me to apply for L1 individual petition..........which my comapany has filed for..............

Going by what happened at the consulate and the fact that the visa officer was not ready to listen to my clarification puts a doubt in my mind whether all this is preplanned (i.e. whom to reject and whom to accept).

I have aplied for L1 individual premium................what are my chances this time around .......will the previous rejection be taken into account when I go in for a interview..................

Do advice me on this....................
 
Did you apply for Blanket L1B? This is usually given to people with specialization in computers.
But recently heard that they r rejecting BL1B's and asking people to apply for Regular L1B's instead. Is this true?
 
what were the 3 questions you were asked? i am also applying for L1B VISA.


Please give me any suggestions the forum members may have.
 
Hi ,

My L1B VISA got rejected. He told that i dont have a specialized knowledge.
In the Form they gave me the reason mentioned was RCA.... What is RCA....
Kindly give me answers if you are aware of RCA.

hi all i am having my interview scheduled on 14apr.....i am pretty nervous reg the question asked.....can anyone let me know reg the same....and moreover i am from Electrical & Electronics Eng ..but my company has filled my L1B under Blanket......do let me know if there will be any problem.....
 
I have appeared for the L1B Interview on 5th Aug 08, I have got the Blue letter with the point ( Your blanket L-1 is not clearly approvable under section B ( 214.2(I) (11) (D)) 101(A) 15 (L) ticked ). I have already travelled to the UK on bussiness VISA for 5 months, is that the reason for non issue of L1B VISA. Now i'm thinking of applying for L1 Individual, what are my chances of Rejection. Pls help me

HI, I am going to apply for L1B visa.I am working in IBM since 25 months.
There is one condition in IBM that non-cse guys should have 3 yrs of experience.Can pls eny one tell me about the seriuosness of 3yrs condition.Have you heard of any employess rejected on the condition(Non-cse with less than 3 yrs expereience).

My application for the L1 US visa was rejected by the consulate official. My interview was taken by a lady. She told me the that Your blanket L1 application is not clearly approvable under section 8 CFR 214.2(I)(II)(D) and INA101(a)(15)(L).Can you please let me know why my visa application was rejected.

She asked me only four question which I answered confidently but still got rejected.

1.What you will do in US?
1.Verification and validation of data on the PCIO application and validate the data is passed to the PCIO attached system is valid.She told that verification and validation is nothing but testing.
2.Identifying the technical cause and potential impact of error on PCIO application.She told that its a support desk work.I told her that its like validating what is causing that error like why the surcharge is calculating wrongly and what is the impact of the surchare geting calculated wrongly. the premium will be wrongly calculated.
3.Create a detail design document for business requirement of PCIO application
4.Identifyin the scenarios which can be automated as a part of pCIO application and develop automated script using Visual basic script.
5.Create Requirment tracebility matrix for PCIO application
6.Update the documentation of PCIO applcation as code changes are applied

2.What are you doing in India?
1.Verification and validation of PCIO application of all lines of business.
2.report the defect through bug tracking tool like Quality center and track it until closure.
3.Understanding the business requirement document and create scenarios document based on requiremnt for all lines of business.
4.Doing impact analysis to get the list of all impacted modules for PCIO application
5.Validate ongoing changes from new releases are not introducin defects into previously working functionality .

4.What is you experience?
she asked me what experirnce do you have on client application. I said 29 months.

Please let me know why my visa application was rejected. Can I apply again for L1B.What is my chances of getting the L1B visa approved next time if I apply? Please let me know
 
You did not meet 8 CFR Sec. 214.2(l)(1)(ii)(D), not 8 CFR 214.2(I)(II)(D).
Bascially you do not possess "specialised knowledge" according to the consul.

In order to be classifiable under INA 101(a)(15)(L), the services performed by the foreign national abroad, and those to be performed in the United States, must involve either "managerial capacity", "executive capacity", or "specialized knowledge."

L1b blanket extension

hi

i am currently in the US from 01-Nov-2009. i was previously here for a month in Oct-2008.
My visa and i-94 expires on 30th Oct 2010. what are the chances that my extension will be rejected? when am i eligible to file for an extension?
 
Guidance for Maintaining the payroll for L1 Visa

Hi,

I'm in US on L1A Visa which was granted to me for 1 year (My company being new in US), this Visa expires in September 2010.

I have currently employed from March 1st week onwards 4 employees a) Myself-General Manager b)Manager-US Citizen c) Salesman - US Citizen d) Book keeping-US Citizen. The total amount of taxes being paid by me for all 4 of us PER MONTH is $1550 which includes the Federal Tax, Social, Medicare, NY State Tax.

I need to know is this enough and the employed people as above their designation is right to show??

I have applied for L1B on Feb 10 and i got appoinment on March'10 but it got rejected so my company decided to process L1 individual before that due to some project criticality they have initiated B1 for me and It got reject in May'10. Please advise me what is the minimum time to apply L1 individual and is there any impact for L1 individual.
Since my individual docs are ready to file .

I have already having the B1 visa and now my organization applied L1-Blanket for me but Vo refused for above mentioned section

Is there any time frame to again attend the interview
