L1B - Resigning

Hello,
I have been in the US for nearly 3 years now on an L1B, which is expiring in Sept 2006. My employer is in the process of applying for an extension. However, I wish to resign from that job.

I understand that the H1B visa quote is full for 2007, so I cannot apply for another job in the US under the H1B visa.

I have also been with a wonderful US man now for 1.5 years and we are discussing marriage, however we will not be able to marry for a good 6 months or so (as we are both processing divorces). So marriage is my best option for remaining in the US permanently (I think).

So my question is around timing. Can I resign and remain in the country legally, without working, for a short period of time, until we are ready to marry? Under what method would I be able to that? The Visa Waiver Program (I am from the UK)?

Thanks for your help!

your best option for now may be to remain in that job until the coast is clear, for one, you seem clear that marriage is not likely until at least 6 months, though u r from UK and the visa waiver program is an option, you'll probably have to re-enter the US for that to take effect and in any case you're only allowed to stay for 3 mths on the VWP and extension is not allowed. resigning now will invalidate your L1 which leaves you out of status, another option may be seek an employer who is willing to file H1B for you, then resign from your present job when the h1b petition is approved, however its too late for the 2007 quota unless u have a masters degree and the masters quota has not been exhausted for the current fiscal year.

Thanks for your reply. It is much appreciated.
Unfortunately, I only have a batchelors degree, no masters degree, so the H1B visa option is out for now at least.
I was hoping this would not be the case, as staying with my current employer is creating unbearable stress. I am really only staying now in the US for my boyfriend. The work situation is so bad that if it wasn't for my boyfriend I would be packing my bags and hi-tailing it out of here.
Do you know if resigning will immediately invalidate my L1 or is there a grace period?
Thanks for replying :-)
