Hi all,
I m on an L1B intra company transfer getting a salary in India and expenses paid for by the Indian company. I m still on the rolls of the indian subsidiary. Am i eligible for filing a green card application ( like the L1 who get salary in US , and skip labor certification.)

thanks in advance,
Nitin

I do not see any issue to apply for GC with L1B who receive salary
abroad. The employment based GC is for future employment.
L1B mostly likely can not skip LC.

Wrong info. L1Bs in managerial positions do not have to go through LC. All they have to show is they worked in parent company abroad for six months before they can file for 140/485.

I think you are talking about L1A. Interpretation of Managerial position is broad. If that L1B holder is president of US branches, they may be able to skip LC, but if they are project lead, or project manager or director etc, they are not qulified to skip LC. Most of L1B holder is latter.
BTW, Why do they need to show they have worked for 6 months at foreign entity before filing I140/I485 ?? They have to show the employment by foreign entity at least for continuous 1 year in last 3 years when they get L1B.
Having L1B already proves 6 month employment abroad( I actually never heard about 6 month thing, though).

L1 to Greencard

Hi,

I will be having intra-company transfer and will be joining the same employer in US branch in Houston, TX. Employer is going to sponsor L1 visa. I have already worked for 1 year for them. How soon I can file my greencard and can expect to receive it completely. I heard that you can skip Labor clearance, it that true? If not, how much time is it gonna take for LC, I140 and I485?

Thanks,
Pankaj

GotPR is right. L1B holders cannot get GC without going through LC phase. Only L1A holders qualify and can file under the EB-1 category. EB-1 category is very quick and one can except visa anywhere between 6 and 12 months.
