L1 to L2 to H1

Hi,

My husband is in US on L1B visa (his Visa is expired but staying on I94 which is valid till Jan 2008).Currently Iam on L1 visa and planning to come back to US on L2 visa.We are planning to apply H1 for both of us in April 2007.

Could you please throw some light on the below queries that I have.

1) Can I go for L2 stamping on Jan 2007 but travel to US on L2 in May 2007(situation being, my Husband's L1 visa is expired and he is residing in US with his I94 date;Also he would be in COS pending state from L1 to H1 during May 2007 as he would have applied for H1 in April 2007)

2)Can I have my H1 applied in April 2007 and travel to Us in May 2007 on L2.

3)Can I apply for EAD once Iam on L2 in US while my H1 is under process

4)Is it mandatory to work once my H1 is approved in Oct 2007 or can I stay at home for few months without working but still be on H1.

Probably OK.

yes.

If you filed COS and got approved, you must work for sponsor. Since you seem to file H1 in your home country, you can not run COS, thus you should be fine not to work.
