Hi,
Currently I am on L1 with company 'A' and my I-94 is getting expired in July 2007 and I am planning to apply H1B with company 'B', please clarify the following

1) Is it possible to apply H1B with COS even though my I-94 is getting exired July (of cource I would be applying for L1 extenstion some time in June/July)?

2)If I apply H1B with change of status in April and it gets approved in June with effect from Oct 2007 and at the same time my current employer 'A' applies L1 extension and that gets approved later than H1B approval means my H1B (which was approved before L1) would be cancelled?

3) Is it required to go out of the country before working for comapany 'B' if I apply my H1B with out COS

1. It's possible, but I'm not sure whether COS is approved when it is obvious that you won't have status on Oct 1.
2. Whichever approved later will rule your status. H1 petition is still valid, but your status will be gone. You need to get H1 stamp and reenter or file another COS from L to H again.
3. If you received I-94, you do not need to travel.

Hi,
Thanks for reply..One more scenario,
Since I am on L1 and if apply H1B with out COS and after approval do I need to go out of country for stamping before working for H1B company.

i.e. Is possible to apply L1 extension and H1B (with out COS) independently and after both the approvals, can I change the status to H1B and work for H1B company as being in USA with out going out of country.
