I am working with company A on L1 and have I94 till July 2006. Company B filed for H1B for me in 2005 and got approved in Nov 2005, but still I am working with company A. 1. Due to some reason, if I can't join company B (on H1), can I continue to work for company A on L1?
2. If I send application for extension of I94 for my L1, will it create any kind of issue for me?

Your earliest reply would be highly appreciated.

Thanks !!

It depends on how you filed H1 petition. Did you get new I94 attached to H1 approval notice ?

Yes. H1 has I94 attached and valid through 2008.
As per employer of company B (H1), it was filed as Change Of Status.
Based on above details, would you please answer both of my questions.

Thanks !!!

1. If your H1 start date has already passed, you are on H1 status, not on L1, therefore, you MUST work for H1 company, otherwise you are considered violating H1 visa rule. You can not work for L1 company unless you change back to L1 or you go out and come back showing L1 stamp at POE.

2. It invites troubles, as you are not supposed to be on L1 status at this moment.

In that case, is there a timeperiod within with you should join Company B on H1 ? KIndly reply.

Thanks.

As far as I know, there is no official timeframe, but some people are saying H1 must start working within 60 days. I also see 60 days rule at murthy.com, but again, i did not personally confirm this with law.
