L1-H1-GC query

Hi...

I am working as a software engineer for an MNC based out of India. I am currently in USA with L1-B visa for the last 4 years.
I am trying to switch over to other company after getting H1-B for this october.(this means that it would be almost 4yrs and 9 months in L1-B.)
I have few questions:
(1) If I apply for H1-B, how long can I work in US with this visa?
(2) Am I eligible for applying Green Card? Do you see any problem in getting the GC processed?

NOTE: At this time, I have 6+ years of IT Industry experience in the same firm. I'm a Masters Degree holder(non-comp science from India). My wife is also a software engineer (now an house-wife) and would also be interested in working here.

I have query .I had applied for my H-1 and i got a query where in they are asking me for my Birth Certificate.My Birth Certificate is in Hindi.What do i do.I have also got to affidavits to support the Birth Certificate.Do i have to submit "Certificate of Non- Availability" along with it, if so can any one giveme the format for that.I would be grateful if someone can give me as soon as possible.I need it very urgently.I would appreciate this help.

1. You can be on H1 for 1 year and 3 months unless you timely file LC.
2. No problem except for that timeframe is quite tight as you have only 15 months to 6 year limit and you need a few week for ad before filing PERM.
You had better ask H1 company to file PERM before you join them.

I have been out of the country for 4-5 months during this 6 year period. Will this any help in getting extra time period more than 6 years (L1 & H1 combined)?
 
L2(EAD) - H1B processing

Hi ,

Iam on L2 and I applied for my EAD in Dec 2005. Status is still pending.
I applied for H1-B in April. What will happen now. Will my EAD be rejected bacause I have applied for H1-B or vice versa. Please help me. I have no clue what is happening .

I can't predict how USCIS treat yours, but logically applying for L2 EAD should not do anything with your H1 application and vice versa.
 
Experience letter for H1

Hi All,

I am faced with a new problem now. My spouse is on L1 and he has applied for H1 this year. We received a mail from USCIS requesting experience letter as additional evidence.

He cannot ask his company for experience letter now since he will not be working with them once he gets his H1. They are not aware of his H1 filing at all. Is there any alternative document for experience letter. What other documents can we submit instead of experience letter. He has couple of documents with him which are

1) Recent appraisal letter
2) Paystubs
3) Pat on the back certificate.

Will these help. Please let me know asap. Thanks in advance.
 
Any letter that proves employment should suffice it. I have heard of alternative as co-worker's affidavit. You should talk to your lawyer.
