I am soon planning to file for both EB1-A, and EB-2 NIW.
Already have EB2 (I-140)through employer approved last year.
My credentials.
MBBS from India
Residency in US form a University Program
5 Publications recent with last 2 years( 3 first author)
Two presentations ( One international and one national)
Two manuscripts submitted ( both first author)
One abstract submitted ( International meeting)
Reviewer for two international journals.
Full time clinical job currently.
Two citations
Awards during residency
Sigma Xi, Who is Who etc
refree letters form Yale, U Penn, MD Anderson
Thanks

Only 2 citations will probably reflect badly for EB-1. Otherwise, it might be doable, a lot has to do with presentation of your petition. Also, I'm wondering why you need another EB-2? An approved NIW will not help you if EB-2 is retrogressed.

my first EB2 is employer based, while a EB2 NIW is a self petition so, i wont have to stay with the same employer in case NIW is approved ??

You don't have to stay with your employer with a regular EB2 either. Just continue working in the same field. Search for AC21.

I think that despite what others have said you have a very good- excellent chance of an EB1 given the clinical background. That's as important as publications. Choose a good attorney

Thanks you for the replies so far
I was of the understanding that to get AC21, you have to have filed I-485. However, I cannot file for 485 because of retrogression

You should meet 3 criteria for EB1A. First, both publications and citations are not strong enough. More over, you don`t have third criteria to claim. Find other alternatives.
I advice you to contact some experienced attorney.
Good luck.

Full time clinical job currently.

Over all ..ur case will depend on presentation

EB2-NIW looks fine. EB1-OR would be worthful but it all depends how you present yourself for any category.

thank you all for the input.

as most of u have recommended, i contact a attorney form new york, who i was told is a expert on Eb1 cases especially for physicians. he quotes me chances of around 90 percent...not sure..may be trying to hook me.
anyway i have decided to go for it.

in addition to my credentials above.... I also have recently got mutilple invitations form various peer review publications to write for them. how can i use that to strengthen my case.

also got few more letters from faculty at Louisiana state university, temple university, and university of Missouri.one of them is form my home program... and rest form so called independent referees.

one of my publications was partly supported by a grant form canadian university, i was third author on that paper. i have no way of getting any information about that grant....although it is mentioned in the footnote of the published paper. how can i use that information.
thanks again for all the help form u guys

it is better to add more external letters, letters from other countries and to have some lett from US goverment labs as well to make EB1 stronger.
good luck.
