K-1 Granted - Job Offer Received - Next Step?

Hi all,

I have been granted a K-1 visa and will be entering on it in 5 weeks time (mid November). In the mean time, I have been applying for jobs in California and have received an offer from a company out there (current start date, 6th Dec).

1. Now, from my reading, I am not actually allowed to accept this position until I received my EAD (around 90days after application post-marriage), is this correct?
2. However, I am aware that there may be a loophole if I fly in to JFK and obtain an employment authorisation stamp, if I receive this, can I work immediately? (I think I might have read somewhere that this has changed recently, and is no longer valid?)

Has anyone else been in this situation, how you go about this?

You are right about having to wait for your EAD before you can start working- so apply for your AOS and EAD immediately after you get married (usually EAD takes about 60 days to be received).

As for the JFK stamp- they used to give this out (not too sure whether they still do), however the wording on the I-9 that employers use has now changed and so the stamp can no longer be used. You'll just need to wait for your EAD.

Ok, Just for clarification, is it illegal to accept the job offer (and not work) before I have my EAD? I know this sounds unimportant, but I'd like to accept it, and give them assurances that that I will work ASAP.

I'd like to second elc's advice to file your EAD asap after marriage. And to reply to your question, I don't think it's illegal to tell a company you'll work for them (accept offer) without work clearance, so long as you don't actually work.
