How USCIS Processes Retrogressed Visas Cases

If, at the time of adjudication, an applicant’s priority date no longer meets the cut-off date published in the Visa Bulletin, due to retrogression, his or her case must be held in abeyance until a visa once again becomes available. If the adjudication of your Form I-485 will not require an in-person interview at a USCIS office, then your case will be held at the USCIS Service Center where you initially filed your application.
If you have been interviewed at a USCIS office and a visa is not available, then USCIS may hold your case at the following locations until a visa becomes available.
  • Employment-based visa-retrogressed cases are held at the Texas Service Center (TSC) upon completion of any required interview and other processing steps.
  • Family-sponsored visa retrogressed cases are held at the National Benefits Center (NBC) upon completion of the interview and other processing steps.
USCIS will finalize processing of visa-retrogressed cases when applicants' priority dates become available (current) based on the dates in the current month’s Visa Bulletin. If USCIS needs updated information from an applicant, we may send out correspondence such as requests for evidence or an interview notice. Therefore, it is very important that applicants keep their addresses current with USCIS.

Since DV visas are reserved for Consular Processing but are not reserved for AOS processing, my question is when all the available visas for a region are reserved for the interview at the Consular offices, will AOSers be able to get that reserved visa if those visas are not yet issued at the time of interview of AOSers?
It looks like for the AS region the maximum number of the cases are ready to be scheduled for an interview at the consular office and I was wondering if the scheduling of those cases will impact AOSers because of the reservation of visas by the Consular offices resulting in limited visas for AOSers for the AS region.Screen Shot 2022-05-25 at 2.11.53 PM.png

I don't know, but they have listed Madrid as SA, Madrid is EU, and that one is the most notorious.

Firstly, regional allocations are not hard limits so that’s a red herring. The only thing that matters to you as an AOSer is if there are any of the total 55k visas left at your interview. If we reach a situation (would almost certainly only happen in September if it does happen) where all the remaining visa numbers are allotted to CP, there will not be one available to you for AOS regardless whether those people have interviewed/been issued yet - reserved means reserved. However, if there is a no show or denial at interview, those visa numbers will get put back into the pool, so those would become available for AOS.

Where can I find an explanation of what the columns mean? What is AP? What do the 2 numbers mean? What does the bold and non-bold numbers mean?

WHAT DOES CURRENT MEAN PLEASE ?

August VB is also all current.
I guess the previous note meant what was written: They made everyone current to maximise the visa usage. If it was an overshot, they could have retrogressed. I'd say their language was indeed a bit implicative. But, seems like they are just unpredictable.
I guess it now kinda hints that the Visa Office doesn't project all visas to be issued. Maybe a 0.1% probability of the retrogression for September, but I doubt it.

P.S. they did have a problem with their system not coping with all going current, which became apparent in late April. It seems that their IT folks have found a solution for it. Hopefully, it's not a solution making ten unforseen problems and their solution scales into September and clearances.

Hello,

I recieved my interview notice and they need a copy of my medical examination. I lost this copy, is there any way that I can get another copy from the clinic that took care of my medical?

Thanks

Why are you posting an AOS related issue on the general VB thread?

Anyway, you'll need to contact the clinic to find out if they kept a copy of your medical report. We have no way of knowing if they did or not.
