Not true. The salary can be less, but it must not be so much less that it looks like a different type of job. Going from $80K to $70K should be OK, but not $100K to $50K.

Also, there is no restriction on the location of the job when you use the AC21 portability.

What if salary is more? If salary quoted on labor is $75K and new job gives me an offer of $100K or more. Will this be a problem?

Don't Fall Into Uscis Trap

Those of you who are planning to jump on filing 485 on July 1st, please don't fall into USCIS trap. The best bet would be to wait till July 30th and file on that day.

Let me explain the math: Current fees for I-485 + I-765 + I131 = 395 + 180 + 170 = $745. Then from next year on until you get your GC you will basically be funding the USCIS coffers with $340 + $305 for EAD and AP for the next 4-5 years. If you file with the new file structure i.e w.e.f. 30th July you will only pay a single amount of $1010 (which includes 485, 765 and 131) and you don't have to pay a single penny when you renew it every year from next year onwards.

I have already paid close to $1450 till now on 485, EAD and AP and from july 30th onwards, if I have to renew my EAD and AP I have to shell out another $645...:mad:

SO PLEASE DO YOUR MATH AND DONT FALL INTO USCIS TRAP.
 
Your suggestion of saving couple hundred dollar could be nothing compared to early RD date they get by filing earlier.

Do the math yourself when 200 to 300K people trying to apply starting 1st July and during the approval time this RD/ND will come handy, your suggestion could prove them costly in the long turn too.

My suggestion is both are valid suggestion act accordingly.

If the PD is old then it does not matter when you apply. But if PD is new apply as early as possible.

People always calculate losses, but they never include gain in their calculation.
If your spouse can work and earn money, don't you think couple of hundred dollar are peanuts.
USCIS is for us and completely FEE based department, let us give some more money and keep them happy :)

Yes, you may be right. For somebody who would get their GC in 1-2 years then it is worth applying on July 1st itself. But for majority of the people it is going to be atleast another 3-4 years so in the long run it will benefit only USCIS and the 4 week difference will not matter.

Yes if your spouse earns money then spending the money is not a problem, but how many of us have spouses working the percentage may be less. As you said there is no harm in giving them money but if giving them money is going to speed up the process or benefit us then it is okay, but the way they have times the fee increase and making the status current smells fishy and it looks it is purely to collect huge sum of money from becharas like us.
 
I e-filed my I-765, but I just realized that by mistake I interchanged my first and last name in the application. I called up customer rep and she asked me to send a letter to TSC stating my mistake. She also said that if there is a possibility that they could reject my application and I have to file again with the fees.

Has anybody been in this situation before... please let me know. TIA.

It is a grey area, but the general rule is the that bigger the salary difference (whether higher or lower) is the more they will suspect that the new job is too different. It will also be evaluated in the context of the salary variation of the occupation. A lawyer going from $90K to $150K would probably be viewed less suspiciously than a programmer doing the same.

They're talking about the spouses currently not working but could start working if they had an EAD. That percentage is quite high, and in those cases the spouse's new income far outweighs the cost of the EAD.

USCIS may/must Introduce Premium Processing for EAD/AP

The way things have gone so far within the legal immigration system (if there is a consistent one), I would welcome 'Premium Processing' for EAD and AP just like they have introduced PP for I-140. I wouldn't be too optimistic of PP for I-485 but it seems only logical that they introduce PP for EAD and AP with the flood of those applications arriving in June and July mainly from Indians, the milking cows of the legal immigration system.

Please don't take me wrong as I am one of them too.

The only reason why i may believe ur 'file I 485 on 30th' deal is because u have already filed for your I-485. Otherwise i would bet 1000$ for u to show me a rcpt saying u filed on 30th july rather than earlier.
