Joint sponsor question.

My father is a joint sponsor for a petition for him and my mom from my older brother. He owns his own construction business. He does not have an employment authorization but I don't believe one needs one to begin their own business. My father received a letter asking to show his authorization to work here. Can my father not be considered for a joint sponsor at all? or can we send a letter explaining the situation?

He cannot be considered a joint sponsor if his income comes from unauthorized work. And yes, one needs employment authorization to do any work for a business.

Employment authorization is required to work in a self-owned business, although it is not required for an owner who is only a passive investor.

Is there a way to submit tax returns directory to INS when sponsoring a person, thereby limiting who sees that confidential info? thanks
