Hi Guys,

Here is a case:

GC was sponsored by a different company (not my employer at the time of filing) as a future employee.

It was Labor substitution.

I140 Approved, EAD received and FP done.

I have started working for the sponsor using EAD for about 3 months now.

It's more than 180 days since I-485 was filed.

Now can I switch to another employer?

you are eligible for AC21 - but do as much research as you can to make sure you will be approved under AC21

COMPANY A APPLIED FOR MY GREEN CARD.
AND MY I140 AND I485 ARE IN PROCESS.
I GOT OFFER IN COMPANYB.
THE PROBLEM IS COMPANY A DID NOT APPLY FOR MY WORK PERMIT BUT APPLIED FOR MY PARTNER.
I DONT HAVE EAD.
IS IT OK TO LEAVE COMPANY A AND JOIN COMPANY B WITH OUT WORK PERMIT AND APPLY THROUGH COMPANY B .
OR IS IT SAFE TO APPLY THROUGH COMPANY A AND WAIT TILL I GET WORK PERMIT.

EAD (work permit) is not stuck with an employer. It can be used anywhere

My employer did not apply EAD for me at all but applied for I140 and 485 with out appling EAD.Is it ok to change company with out EAD.

U cannot work without EAD or H1. You would have to either transfer ur H1 or apply and get EAD before changing job.

Note that:
1. u require the actual physical EAD card before u can change job, just an approval status from BCIS website is not enuf.

2. u can apply for EAD urself. 485/EAD/AP are UR applications and not ur employers.

what is your current status? H1B? If so, you need either H1 for company B or EAD in order to work for company B.
