Jan 2002 RD, no news whatsoever

Hello everybody!
Me RD January 2002.
3rd EAD filed September 2003, expecting approval soon.
3rd AP ready for filing.
No 2nd FP, No RFE, No transfer, No approval.
1st FP in June 2002.(passed 18 months).

Should I:
a. Contact Senator?
b. Wait for EAD approval first and then call NCSC?
c. Call NCSC? (tried calling earlier, no results, fake assurances).
d. Wait patiently for 2nd FP/RFE/Transfer?
e. Ask lawyer to write a letter?
f. Write a letter to USCIS myself?

How do I know what's going on with my case???. Just following up with you guys. Wish to take a step now instead of waiting for another year and realizing that I should have acted earlier.

Looking at the current trend of 2nd FP, looks like June 2002 (1st FP's) are receiving re-FP notices.
Tired, very tired and disappointed.

identical case as urs, same dates as well, applied for 3rd EAD, AP still pending, no 2nd FP or rfe, RD jan.2002. But I tried senators office almost 2 months back. Told me to wait for 2nd FP and it would take 60 days. So I am thinking again going back next monday when I complete 60 days of wait time. I think something is cooking for us very badly. BTW which state are u from
 
Mine is slightly later - though the same situation.

RD: 02/2002 (NIW); ND:03/2002; FP1: 04/2002; State: NY; Applied for 3rd EAD, 3rd AP one month ago. No 2nd FP, no RFE, no transfer/AD.

Looking at the 2nd FP's graph, looks like most of the April 2002 (1st FP) have recd 2nd FP notices.
Have you checked with Senator/USCIS?.
As a matter of fact those around my RD/EAC have already done 2nd FP's and to my surprise, some have done 3 months back and some got approved 4 months back after their 2nd FP.
USCIS jokers seems do not follow any specific pattern.
My fear is that since we have been ignored for so long, god forbid, may take another year or two to get approved because there is always an crucial factor pending and that is RFE and Transfer.

My area congresswoman Sue Kelly's office replied me in the last week of October that our cases (mine and my wife's) were awaiting scheduling of 2nd FP and that we should be receiving 2nd FP appointment in few weeks to 30 days. Nothing so far even after 45 days have passed since that reply.

What will be your next plan of action after 60 days?
What can be done like in your sorry state of affairs when a senator gives it in writing that you WILL receive 2nd FP in next 60 days and you don't receive it?
Send a copy of that letter back to senator and ask him/her, NOW WHAT?
I know nothing will happen. Sorry about that.

Mine is an NIW case so I am expecting transfer to NYC some day. And the local office schedules interviews according to RD and not transfer date (assumption). So if my case lies longer with the VSC, probably I'll get interview faster!

Humor aside, I don't think senator/congresswoman would help much - though I am thinking to re-inquire through them if I don't receive FP2 by the end of this month. I hope my pending petitions for EAD3 and AP3 might remind them of FP2. Let's see.

Looks like contacting senator/calling USCIS will not be of any help.
Lets see if FP2 is triggered by filing 3rd AP or 4th EAD.
or else WAIT.
 
you are not alone

i'm runing scan on Jan 9 2002 RD and so far less than 30% of 485 cases has been approved , so your case is not special. My friend contacted sentor ,and senator was told that VSC is actively working on NOv & Dec 2001 cases, which does not preventing them from posting Jan 15 2002 in the last 3 month. I called NSC and was told not to bother them as it has to be 30 days past the official date (Jan 15 2002) from your RD, before you can make an inquiry now.
 
Similar case. RD Jan 8th 2002. No FP2. RFE response recived on Aug 22 2003. Applied for 3rd EAD/AP in October. No news. What should I do gurus? Will the EAD/AP filing trigger FP2?

When did you do your 1st FP? What state R U from?
You are in a better situation if you compare with the rest of Jan cases because you are more or less done with RFE part unless you are transfered.
If your 1st FP was in and around June 2002, then I guess filing your 3rd EAD/AP would trigger your 2nd FP.
Just a guess.

but contacted Senator three times.
1st time - your 2nd FP will be scheduled in 30 to 60 days.
2nd time - your 2nd FP will be scheduled in 30 days.
3rd time - waiting for response from Senator.

When did you do your 1st FP? What state R U from?
FP1 was late May/early June 2002. I am from NJ.

My RFE response was actually received before my FP1 expired. But I have not heard anything after that. I feel the IIO handling cases close to my date is not bothered to even send FP2! So I thought that filing the 3rd EAD/AP would probably trigger it.

Contact Senator? my opinion Yes offcourse . It is late but go .
Contact local Congressman also.It will help some to find status of yr case. tell them you need to know what is status of your case.It will definately help you.Good luck.

I will contact my Sen. and lets see how it goes?
The beauty of dealing with USCIS/Senators is that even though they give the assurances and informations in written, no one can challenge this, if his/her assurance do not happen finally.
I spoke with my lawyer today and I am told that the senators will be of no use. (words of my atorney).
Still wud like to go ahead.
 
MJRDJAN2002, search for Lautenberg in this forum. I think you will get quicker from Lautenberg compared to Corzine.
