j2 visa with 2 year HRR,got my h1b visa

Hi,


please help me in this situation, I came to US on j2 visa in April on 2 year HRR and one company applied my h1b for 2007 because they selected me before getting my j2. I got my h1b but now my attorney is saying to get 2 year HRR first then they will give my h1b. My question is

1. Can I work on h1b with 2year HRR ?
2. How long 2 year waiver will take ?

1. You can not get H1b if you have 2year HRR
2. It depends what kind of waiver you will be asking. If it's no-objection and you did not have government funding it should not take long once you get no-objection statement from your government. There are delays with the final USCIS processing, but again, I got mine pretty quickly.

Hi Nemu,

thanks for responding, I will give you some of my detail. I came with my spouse and I am on j2 visa with HRR. My spouse got post doc position and it is independent like no Indian fellowship involve and we were in Japan for two years before getting this fellowship so I don't thinking getting NORI from India is a problem, we have already applied it.
