I am a physician doing my J1 waiver. My priority dates are current. Could I apply for my 485 now, or do I have to wait till I finish my waiver to begin applying.
Thanks
MMED - Please don't give wrong advise. It will put someone in trouble. Sorry for being rude to you .
BDEV -- If you are I1 physician, currently doing your waiver ---I would suggest u start gathering papers asap for NIW - EB2 I-140 application and also concurrent I-485 filing. This will give your dependents a chance to get and use EAD and advance parole. You will not be able to use EAD and AP before your three years of waiver is done.
In case of PERM based I-140 you have to wait for total of 3 years before you can file your I-485.
I am not an immigration lawyer. Please contact a good lawyer and get proper advise on which you can rely.
I have a question, and would appreciate if you can help me with it:
My J1 waiver application was approved by both HHS and DOS. The application has been forwarded to USCIS. I am going to leave my current employer (which applied for my waiver). I really do not know that this is safe or not now? Will HSS (as the IGA) or USCIS follow up with my curent university to see if I am still working with them? My application was a research-based application, and apparantly has no service obligation.
