J1 to IR1 AND J1 to K3

Hi Frans...

I would like to take your help for below case.

- I am an Indian citizen and was there in USA on J1 visa ( Dec 2005 to June 2007)
- I am subject to 212 (E) clause.
- Currenlty I am in India.
- I just got married to US Citizen girl. She is india since last one month and flying back to USA in March 2008.
- We are preparing immigration file for me.
- Do my previous visa ( J1) make in impact on this IR1 visa? If yes then what is the procedure to avoid any impact ?

Is it possible for me to go for K3/K4 visa ? Again any impact of J1 here.

If you are subject to the 2 year home residency requirement, you have to fulfill that first or obtain a waiver...

You will not be able to travel to the USA with immigrant intent until you do either one of those.

Now what would be the best approach to get waiver...I mean ( NOC or external hardship etc...)
