J1 to greencard based on marriage

Hi,

I am married to an US-citizen.
I have been on a j1-visa.
After receiving the final approval from USCIS regarding the waiver of foreign residence requirements (The waiver process took 3 1/2 months), I would like to apply for a green card.
I am wondering whether I have to submit the I-130 Petition for Alien Relative.
As I read information on the USCIS website, I have believed that I do not need to submit that form, because I have already been to the USA.

Am I right?

Does not matter where you are. You need I-130.
 
Hi Butterfly2006....I would like to be in your potition right now! :) can you please share what was the reason you gave to obtain the waiver? I´m with the 2 years requirment because of the Skill List. I would like to marry a permanent resident but I don´t know if just saying that not my gov. or US spend money on me while I was a trainee is enough...any ideas please??? :confused:
ah! one more question...were you in US while doing the waiver? I´m in my country right now and planning to go to US as a tourist and start the waiver process...
