J1 to DV GC change of status

Hello !

I have a couple of questions regarding DV2014. I am currently in the US on a J1 Visa and I found out two days before I came to the US that I have also been selected for DV2014. My CN is 2014EU0003XXXX, and my question is what are my next steps if I want to adjust my status in the US and not go back to Romania, my home country. I emailed KCCV and haven't gotten a response from them yet, so I am kind of lost at this point.
My J1 visa expires at the end of September 2013, I already sent my DSP-122 and DS-230 forms to KCCV, and put USCIS at the location where I want to have my interview, but again, haven't gotten any response from them.
If someone could please answer my question of what my next step should be, I would really appreciate it.
Thank you !

No i am not. But i forgot to mention that I have a dual citizenship ( hungarian and romanian ) and i have my j1 visa on my hungarian passport, and I was selected as a romanian... I guess that makes everything more difficult.

It doesn't matter what passport you're using or what citizenship you hold as long as you can prove you're eligible according to country of chargeability (usually through your birth certificate).

If your J visa is set to expire in Sept 2013, you cannot remain in the US beyond that date legally, which means you cannot do AOS or is there a different expiry date on your I-94?

Being in the US already is not enough ground for doing AOS, you need to be in status as at the time of submitting your package (and the time of interview for some applicants). So you need to confirm if you will still be in status by the time your CN is current before reasonable input can be provided on what you can or need to do to adjust status.

Hey!

First of all, what does your DS-2019 says about your J1 status expiration, have you requested any extensions? This is the document that rules your status (as the I-20 for those under F-1) NOT the I-94 or the visa itself as I have read over here. You don't mention enough details that would allow us to help you more. On another hand, your visa and the DS-2019 might say you're not subject to the HRR but you have to request an Advisory Opinion from the DoS. They're the ones that will finally tell if you don't need a J1 waiver.

If your J1 status is not or cannot be extended until you're current then you'll have to go back to your country and do CP.

Pryanik :)
