J1-F1, J1 HRR waiver

Hi
I am in the US on a J1 visa and my field of research might be subject to a 2yrHRR.I have applied for an advisory opinion for the same. I have got admission into a Ph.D program and would need a F1 student visa.
I have a few questions

Can I apply for a F1 visa before my waiver comes through?

Would I need my waiver when I go for my F1 visa interview?

Could I visit India to get my F1 visa when my ds-2019 (IAP-66 ) is about to expire?

I noticed that you had applied for advisory opinion to DOS. Can you please provide some pointers of what should be included in request for opinion and where to send.

Really appreciate your help.

they have an online application. Along with the required documents I also sent my own personal letter of why I feel there is an error in subjecting my field in the exchange visitor skill list and therefore need a clarification of the same.
I also included a letter from my employer saying exactly what I have been doing.
But to make sure you dont waste time please check the exchange visitor skill list pdf available online in the same site and see if your field is in the skill list for your country. Advisory opinions take generally two months easily . If you are subject you might start the waiver process which is long.
its upto you how much time you have at your hands.
the forum has postings from Mr. Kalingan I found very useful please search for them.
 
Thank you SS79. Though no offense meant to the skill list, but I see all possible areas of science, eng., medical, social sciences in this list. Now as far as I know, many F1s come under these areas too.

Can you please elaborate a little more on the clarification that I should sought from DOS. If you can provide a hypothetical example, that will be really helpful.

there are no details. HRR only bars you from getting H1, L1 and an immigrant visa. You cannot change your status in the US, so you have to leave the States, get an F-1 visa and enter the States with it.
