J1 and eb2

Hi,

I have a PhD and 6 publications all peer reviewed in top journals and I am currently a postdoc in a university. My visa status is J1 but It seems that I would be eligible to get a green card under the EB2-NIW as I work on HIV. But how difficult would it be to jump to a green card under a J1 visa. I am not subjected to the 2 year home rule requirement but would it be easier to change to H1 and if so is there a lot involved in that process.

If you are eligible for NIW with current PD (not from India or China), and not subject to the 2 year home country/have waiver, it does not matter to apply from J, from H, from your home country ....etc. It is the same and I applied directly from J. It is the time left on your J. If plenty of time left, go ahead and apply from the J.
