J-1 visa holder and green card application through marriage

Couldn't find related post - so here goes!

Can a J-1 visa holder apply for a green card if they are newly married to a US citizen? The visa runs out in 2 years but I only have funding for 1 year so in a years time I may have a visa but no DS-2019. The visa is not subject to home residency rule.

you are looking on a life example. I came on J1 in 2005. But they did not like that I married my wife so quick after coming to the US. We are still pending approval, after 2 interviews, have some identity fraud on our file, waiting for USCIS response.
 
phyras, are you sure that the J1 visa is not subject to HRR? did you get an advisory opinion from the US Department of State? because mine said I'm not subject to HRR but after getting an advisory opinion from DOS, they said otherwise so I had to apply for a waiver.

just curious... :)
