J-1 to H1 B

Hi guys,

I am an Australian Citizen currently on j-1 visa and stamped as duration of stay. My visa expires on 31-March-2005. I am not subject to the 2 year home residency rule. I want to apply for H1-B in april 2005.

One attorney said that once it expires i should go back to australia and only after 1 year can come back to apply for h1.

Can i apply for H1-B in april 2005?

Please advise me,

which one is expiring: your visa or your status? Two very different things, you know.

Thanks lucyno for the reply. It is my j-1 visa expiring and not my status. I shall also put my question in h1 sub section.

You should only worry about the expiration of your status. The date is indicated on your DS-2019. As long as you are in status until october, I think you should be OK. :)

And, yes, you can apply for H1B.
