IV descheduled

Can you please tell me what you wrote on your letter, I will use the same format. Also where did you sent your letter to , is it to the Service Center or the District Office ?

1) Do you mean on your infopass, the officer told you that your NAME CHECK is cleared ?

2) Did they rescheduled your IV or you are still waiting for new appointment ?

I scheduled the infopass to find out why my interview was cancelled not for FP, was just remarking that that was all the info they could tell me at that time (which was irrelevant really) based on the 2 computer databases the agent checked.

So 1) No and 2) I am still waiting for a rescheduled notice.

Will keep youo posted when I get rescheduled.....hope that helps.

To avoid being the bottleneck, they indeed usually ignore their own regulations. But that only resulted in more lawsuits, so it may be that they actually return to following their regs...

I did some reading on another forum ( realted to this topic) and found the following:

" Congress has added a requirement for the examination process: Effective beginning in fiscal year 1998, Congress now requires completion and review of an FBI criminal background investigation of the applicant as part of the examination process. See Public Law 105-119, Title I, Nov. 26, 1997, 111 Stat. 2448.5 To implement this additional requirement, the responsible agency adopted a regulation requiring that the FBI complete a criminal background investigation of an applicant before the examination may be completed. See 8 C.F.R. § 335.2. 6* " Judge T.S. Ellis, III in the case of Danilov v. Aguirre, et al. USDC Eastern District of Virginia, May 2005



The above applied to the criminal background check done via fingerprints and does not pertain to the name check name checkwhich is authorized under 8 CFR 335.1. What are your thoughts?

8CFR335.2 cleary refers to the Fingerprint Check. There is no law or codified regulation for the namecheck. I beleive, until someone shows me the "namecheck law", that it is conducted under the "Investigation of the Applicant" under 8CFR335.1.

Ok this is fair....but with this I kind of see CIS point when they claim that the 120 days do not start runing till all background checks are completed!!


which I do not like.

we had oath ceremony on 10th December 2010. Got the naturalization certificate and later on in the mail we got letter for my wife which stated as follows:
"This to advise you that, due to unforeseen circumstances, we have had to cancel the previously scheduled Oath Ceremony on Friday, Dec 10, 2010 for the above applicant. We regret any inconvenience this may cause"

It seems that you have gone through the same situation based on this post. Can you please reply back with some guidance. I was wondering how did everything get resolved for your case. Appreciate your help a lot!

I just received one of these descheduled letters today for my oath ceremony that was scheduled over 100 miles away. In doing some research I found out there was an oath cermony in my home town today... Not sure what is going on...
