My 6 year H1B completes in Aug-2008. My labour was filied only last month so I can't get 1yr H1B extension unless both Labour and I-140 is approved.

I'm anticipating my Labour approval end of Feb. But since USCIS dont have I-140 premium processing I can't get the approval before Aug2008 either. I can catchup my outside travel days which is about 4-5 months. So I can stay here till December.

What are the chances of getting my H1B Extension for 1 year or 3 year?

PS:
If I apply I140 in March, after 6 month even if its pending I can apply for H1B extension?

I have to get I-140 approved before August 2008 or Till December that I can get?

Is it true that if I-140 is pending for more than 6months, I can apply for H1B extension for 1 year? ( or Do I have to get the I-140 approved?)

I haven't heard such a rule. Who told you and any document for it ?

Your I-140 should be approved by August 2008 - that will make you eligible for 3 year H-1B extension provided your PD is retrogressed by then.

I landed in US in July 2005 and renewed by H1 in 2007.This renewed h1 has Nov 2009 as its last date.Will I have to leave the country after that period or can i get two 1 yesr extensions after Nov 2009.

You can extends your H-1B beyond 6 years if the LC was filed more than 365 days ago or if I-140 is approved while the PD is retrogressed.

You qualify for one year extension if-

your LC is approved (makes no difference how new the LC case was) ;

OR

Your LC ia approved and your I-140 has been filed (and is pending).
