Presently I am on H1 and my wife and son are on H4 status. We filed I-485 on 31st July 2007 and obtained EAD and AP. My wife and son have gone to India and they want to enter USA in this month. As they will be entering on Ap, their status change to 'parole status'. I was told by some of my friends, when they have travelled on AP, they were not given I-94 while entering USA.
In order to renew their H4, we need to have I-94 form.
My question is: At port of entry they should issue I-94 while entering on AP or not necessary.

I request attorney to help.

The only aliens who do not receive I-94s at the POE are Permanent Residents and Canadians entering in B status. They'll get an I-94, but why do you want to extend their H4?

Amost any one without GC or USC should be issued I-94 upon re-entry including those return back on AP. Your H status will not get affected because you/your family got parole status upon return.
