Yes. For EB2, hourley rate should be minimum of $46.
I don't know for EB1 and EB3.

No offense, but I call bullshit on this one.

There's no requirement for any particular hourly or yearly wage. You do, however, need to be above the prevailing wage as set by the SESA to get your LC approved, and you need to be above 125% of the poverty line (which is around $15k/year). That's it.

I personally know of individuals approved for EB2 with annual salaries in the $55,000-$60,000 range. No problems.

On what grounds can you make such a statement that there's a $92,000 per annum limit for EB2?

Salary...

There is no preset minimum for the salary. After all, one's salary gets determined by taking into consideration several factors such as, but not limited to, the qualification of the candidates, geographical location within the US and the cost of living in that area, experience necessary to perform the job, educational requirements, demand-supply etc.

I think prevailing wage serves

as the guideline for INS. Labor department approves labor clearance based on prevailing wage. To know about the prevailing wage in your area, please follow the link to online wage library:

http://edc.dws.state.ut.us/owl.asp

I don't think there is any law for Labor department to strictly follow these wage criteria. However, if they have cleared your labor, they are good with your stated wage. INS cannot question your salary if you are getting that.

It seems, recently INS has started questioning people (ref: Murthy website and this forum as well) who earn lesser wage than what was specified on labor certificate.

We still need to wait and watch how these issues shape up in the months to come.
