I am currently working in company A and have my H1B visa approval for company A. My H1B petition was done under change of status. My status will change from F1 to H1B on October 2008.I have the following questions:

1. Can I change to company B after October without getting the visa stamping done for company A?

2. Do I need to go out of US and re-enter to get H1B stamping done before I change the firm to be on a safe side?

3. If not stamped, can Company A cancel my H1B?

Thanks
Aditya

Let the company B file H1 transfer petition for you with USCIS, once the petition reach USCIS then employer B will get H1 transfer filing reciept. one you get H1 transfer reciept from USCIS you can join B. Please remember at this time USCIS is asking lot of documents and company B lawyer should know about it. if you get H1 transfer with I-94 attached with H1 transfer approval notice then no need to go out and can work with B till new I-94 expiry date. if you go out then you will need Visa stamping (if employer A visa gets expired when you come back) if Employer A visa stamp is still valid when you come back to US then show valid visa stamp through employer A in passport AND H1 approval of employer B at POE and you will get I-94 till employer B H1 approval notice validity.
