Hello all
I think i might be in a problem
I have EAD approved under EB2 NIW -Exceptional ability (I485 under retrogression). After I left my fellowship in nov 2007, i did moonlighting under Oncall physician staffing company for about 5 months during which time I did not have any job. Only when I filled up the tax returns, I realized that it was a self employment since i was an independent contractor. After this I took up a job and continued moonlighting also till june
Someone mentioned recently Self employment is not allowed for EAD. Is this true even it is NIW non labor petition and how much problem this can cause for GC approval
My second query is will they ask for evidence for continued reesearch endeavors before the final GC approval
I would very much appreciate an input
Thank You

EAD allows you to work any number and type of jobs, including none or self-employed. If your I-140 was linked to a particular job it would be an issue, but since you are NIW thats not a problem either.

As nscagony said, since you are not tied to an employer then you are working legally. However your second question is important:

will they ask for evidence for continued reesearch endeavors before the final GC approval

If your I-485 is at NSC then there is a very good chance that they will ask for evidence that you "continue to work in the field of national interest" that your petition was based on. TSC may or may not ask, I don't know, but lawyers always ask their clients to be prepared for this specific question. In this case, you will have to be prepared to provide such evidence, if asked. This is especially true since it will be a significant period of time between I-140 approval and I-485 adjudication.
