The H-1A sunseted a few years back. There is the H-1C, but it's so restrictive it's pretty much useless.

Are you aware that nursing is a "Schedule A" occupation? Your friend could have an I-140 filed on her behalf immediately.

Thanks for your reply guys.

Hi TheRealCanadian you said something about Schedule A ?...

what does it say.Can you please expalin it or Can you give me a link that explains it.

Thanks again...

A Schedule A occupation is defined by the Department of Labor has being in demand in the US, and therefore no Labor Cert is required. There are only two occupations - nursing and physical therapists.

Her employer can file an I-140 immediately.

For nurses there is no need for an HI. They can get GC's back home if they can find a sponsor this side. I know a nurse back in India who is close to getting her GC along with her husband.

I got 2 nurses from India on H-1B but they had master's degrees. at the . if the Nurse has a bachelor's degree in nursing she can obtain a H-1 visa aftr passing the CGFNS exam. If she has a Masters it is even better. indian nursing dipolma is not recognized in the US. The advantage of H-1B is that it can be done very quickly as compared to a I14- where even if you bypass labor cert the adj of status takes so long.
Therefore it depends on whether your friend graduated from a 4 year bachelors in nurisng program in india and/or she has specialty training/certification.
