Is it possible to withdraw I-589? My friend sent her application 4 weeks ago and now she wants to withdraw it... Her "lawyer" said she was able to apply for asylum but then she found out this person was not a lawyer (seems like people like to pay for hope... and they do anything to get GC) but the application was already sent to USCIS. Can she do anything now?

I think there is a problem (I hope I am wrong): my friend is form Poland - it would be very difficult to show any evidence that she was treated badly because of her religion (Jehowa witness - that's what 'lawyer' put into the application - she is catholic of course)... Additional, what kind of evidence can she show if she came to the States 15 years ago and suddenly now she applies for asylum ???? I think this issue is not going to go well...
If your friend does not or "can not" withdraw the asylum application then the main question that she will have to answer is "Why did it take 15 long years to file for asylum? andwhat was her status during all these years.." I think she is going to have a tough time answering this. Unless she comes with an exceptionally good and valid reason, there is a big risk of her being deported..!misza said:

Yes, But...
U certainly can withdraw it but USCIS could still use that information on the withdrawn application against u. It is stated somewhere I cannot remember. Withdrawal does not EXPUNGE the record from ur immigration history.
This is the greatest asylum blunder I have ever heard.
If u are going to take such a step why not seek SEVERAL OPINIONS first?

First of all I want to say thank you for your help.
Second - the case is not about me, it is about my friend - I have an American citizenship and when I read posts on the Forum I feel so lucky...
My friend saw a few lawyers but the answers were different: one says yes you can withdraw the petition and it will be best for you; second lawyer says no, you can not do that; third lawyer tells her to keep the aplication in USCIS but get married to an America citizen as soon as possible; fourth says that the case is hard so he can recommend another lawyer... My friend was at 7 law offices so far (I was with her so I know what exactly happened), she spend a few thousand dollars and -believe me - nobody knows what to do ( we found these lawyers on AILA web site so I was positive they would be able to help, but - as I said - nobody gives her more than 50% or they refuse to take it). Everyone says that is the best and the most unbelievable story the have ever heard... I just wanted to help her that's why I posted my thread over here... but seems like she will be going home pretty soon - I do not believe there is any hope or solution in this situation...

I don't think she can answer this question ... She overstayed her tourist visa, she has been over here illegal for 15 years, she gave false information in the application, she was said she could fill out I-589 even if she had been over here for 15 years - but it means nothing: she was the only person who signed the petition for asylum, there was no 'lawyer's' signature, no G-28, looks like she did everything by herself..
BTW she found this "lawyer" in the newspaper: "Green Card - 100%, everything is possible" ...

I think she has chance if her asylum claim is valid. The excuse for not filing application in the 15 years is good if the conditions in the home country have changed in the past few years...For instance Somalia 15 years ago and now...is totally different so is Afghanistan and other countries...
The thing that will get her is the 1 year rule that Clinton put in to file asylum claims.
If her claims are rejected, she has right to appeal 3 times..which takes rougly 4-5 years to go through all the hassle..
But if its a legit claim, I thikn she may have a chance.
