Hello,
I have I-140 Approved and I am on H1B visa. My 485 is pending. Both my wife (J-1 visa) and son (J-2 visa) have 485 pending as well, but they have advance travel document. I have couple of

Questions, Please advice:

1. Can they travel on J-1 or J-2 without affecting 485 petition?
2. Or they have to travel on advance travel document?
3. After re-entry into US, can she work on her J-1 as her J-1 is valid for another year.

Please Guide

Only H and L visa holders are allowed to use their visas instead of AP when a I485 is pending. I have heard that certain J visa holders are eligible for non AP usage, but have not found any real evidence supporting that notion.
If they use AP, they need EAD to continue working.

I'm confused.....

If your wife has J visa then waiver is required prior to change to any visa category.

The most common change is to an H, L, O or other working visa.

Hardship waiver is probably difficult to accomplish and if approved she probably has AP/EAD and not J visa anymore.

I've very limited knowledge so I hope this helps.
