Is it important to send out the 485 application today?

From June 01(tomorrow), all applicants who file their EB2-140 before 01/01/06 could file their 485 applications. Is it important to have application arrive at USCIS the first day? Thanks a lot.

Apart from getting it into the queue earlier, there's nothing different about June 1st versus June 30th.

I understand that one has the whole month of June in which the I-485 can be sent.

My question is what do you think will be the order in which the applications will be processed ? Like the I-140 will it be the application receipt date i.e first come first serve basis ? Or will it be based on the Priority date of the applications ?

Does anyone know ? :confused:

Most of my experience in the I-485 process was back when all of the EB dates were current, and in such a situation by and large it is handled by I-485 application date, not the priority date. As the dates move forward and backwards cases will be taken in and out of the queue, and I cannot say for sure how this will affect someone if the dates retrogress after the I-485 is filed and then move forward.

But generally speaking it is by I-485 receipt date.

I don't understand why people are filing I-140's. I thought if you were on an H1 you could just file the I-485...

No. The only people who can file an I-485 without previously filing an immigrant visa petition (an I-130, I-140 or I-360) are spouses of US citizens who entered prior to marriage on a K-1 and are filing the adjustment within 90 days.

I thought we filed an I-140 to get the H1?? Now I'm really confused. We just sent in an I-485 (PD is 2006), and two other forms, but none were I-140. Is this wrong??

If I were you I would file it right away. There is a difference between filing in the 1st and the 31st.

Take my example. I filed my LC on 21 Jan 2003(EB2). The last time the date was current was on Sep-2005 and after that it was retrogressed. It has become current this month Jun-2007. The wait has been close to 20 months. The PD was on 1-Jan-2003 for the longest period of time. It did move to 8-Jan-2003 for a couple of months. If I was 1-Jan-2003 I would have been approved long time back.

So file your 485 right away.

The day you file your I-485 has absolutely no connection to your priority date.

Do agree with you, but this is what I was trying to say - my LC filing date was 21-Jan-2003 and my 485 PD is 16-Sep-2005.

If I had filed my LC on 1-Jan-2003 I probably would have been out of this mess a long time back.

It has taken around 20 months for my LC date to be current again. So no one ever will know whats going to happen in the future. The earlier you file the better it is.
