Is H1 extension possible if labour filed 365th day

Hi,
My labour was filed on 07-DEC-2004 and my H1 expires on 07-DEC-2005. Can someone please advise if I am eligible to get H1 extension? I have counted the number of days between these two dates. It's 364 if I exclude both the above mentioned dates. That's the reason, I am little worried.
Also, if you think I am eligible, when do you suggest I should apply for the extension? Please advise.

You must understand, INS goes by papers/rules. Even one day! it is problem.

---------- may be problems in extension becase your pending LC dont it 365 days try to recapture the days spent out of US and it should be done through good lawyer and attach all the pages of passport that have Entry stamp to US
