What does a visa denial under INA section 221(g) mean?

A visa denial under section 221(g) of the INA means that the consular officer did not have all of the information required to determine if you are eligible to receive a visa. This means you are not eligible for the visa now, but your case is pending further action for one of the following reasons:

Your application is incomplete and/or further documentation is required - Applicants whose application forms or other documentation are incomplete are refused. If further documents are required to complete your case, you will be informed what is needed and how to provide it to the embassy or consulate. You will also be given a letter stating your application has been denied under 221(g) and listing which documents you need to provide.
Administrative processing - Further administrative processing of your application is required before a decision can be made regarding your eligibility for a visa. You will be given a letter stating this and next-step instructions after the administrative processing is complete.

Is there something I can do about a refusal under section 221(g)?

If your application was denied because documentation or information is missing, you can provide the missing documents or information as soon as possible. After submitting the documentation, your visa application can then be processed to conclusion to determine whether you qualify for a visa. You have one year from the date you were refused a visa to submit the additional information. Otherwise, if you do not provide the required additional information within one year, you must reapply for the visa and pay another application fee.

If your application requires further administrative processing, this takes additional time after your interview. Processing times can vary based on individual circumstances. For more information, review Administrative Processing.

Did they give you your passport and other documents back?
 
you are right SAM, you are denied. You get that 211g form when they want more info or more document. it is AP processing.
 
if they did tick "Further consideration will be given to your visa application after you obtain and present the documents listed above" then it means that it was denied and it needs further consideration. But since my interview was fine, and there was only one missing document for it to be processed, then they need this missing document to finish processing my Visa.

I disagree, but that's semantics from the way the full letter looks it appears that the sentence doesn't need to be ticked, it's simply informing you of the fact that you will be considered further if you submit your Birth Certificate. If they will not reconsider your application once you have submitted your Birth Certificate, it's a complete denial. Resubmitting your BC means they will have to reconsider your application and lift it (hopefully) out of its 221(g) status and issue your visa. Consideration does not mean interview or being re-interviewed, it just literally means your case is considered further and progression is made to a final decision.


When I was handing all my document at the first window, the officer told me don't worry about it, just bring it another time it takes 5 minutes to get this paper.

Also I believe that if it was denied, they will never ask me to come later on and drop the missing document. Why would they need the missing document, and my passport if my application is denied.

I somewhat agree, it's a partial denial until you submit your birth certificate, you are essentially "on hold". Your application will be considered further once they have your Birth Certificate to a final decision.


Below is the letter I received:

Dear visa applicant.
This office regrets to inform you that is unable to issue a visa because you have been found ineligible to receive a visa under the following secition of the immigrant and nationality act. the information contained in the paragraph marked with X pertain your visa application. please disregard the unmarked paragraphs.

X: section 221(g) which prohibits the issuance of visa to anyone whose application does not comply with provisions of the immigration and nationality act or regulations issued pursuant thereto. the following remarks apply in your case:*

drop off requested documents any Monday, Wednesday, pm Friday between 2pm-3pm at the embassy's reception

Provide the original and certified English translation of the Beneficiary's birth certificate.


- Health related grounds

- Prohibits the issuance of visa to anyone likely to become a public charge

- other

-further consideration will be given to your visa application after you obtain and present the documents listed above

- you are eligible to apply for a waiver of the grounds of ineligibility.

Thanks for typing out the letter you got. It is clear from reading the whole thing that it was a 221(g) denial, which can be overcome once you have satisfied the condition of handing in your BC.

Its not AP at all, if it was AP I would have been told

Administrative processing:before a visa can be issued ,your case requires additional administrative processing. WE will notify you when the review is complete ,as it may take several months to complete.IF you have not heard from us in 90 days,you should contact the Embassy to ensure that everything is okay in your case .it is your responsibility to keep the embassy updated of any address or phone no changes for you, and to contact us every three month to ensure that your case is moving forward

If my visa was denied they would have told me come pick my passport and documents and not not kept them for like a week now...

Not to mention, it hasn't been 3 working days yet, Friday,and Monday was holiday for eastern... Saturday/Sunday they are closed

Man I am trying to post to help people out, and some here just posting things they don't know about and stress me out....

Please just comment if you really know what you are talking about, or having a good source.

Exactly. This is the deal-breaker for me, they're simply adding the BC that you submitted to your case file. If you were denied you would have had all your documents handed back to you. Call them on the third working day, it's all you can do.

At the end of the day all you did is mix up your Civil Record with your Birth Certificate, it's not the end of the world, it just means that it will take slightly longer to get the visa.

Don't stress out bud, you'll be fine. :D

SAM it is not denied at all, just waiting for further document, they usually hand over 221g for it. just wait you will get call.Thanks for sharing your info and good luck
 
Sam is fine, his 221g is for missing items. Embassys use the same basic form ( we regret we can't issue visa) for every possible reason that you didn't get approved the day you interview. The same form is used for AP ( extra checks usually due to security/name checks ) missing items , incomplete physicals and outright denials. It is important was they check off afterwards. If they issue a denial they will state why usually in the form of reference to the part of immigration code that prohibits the person from getting a visa. If it is just a request for more things you give what they ask and they decide if they have enough or if you need more/another interview. The wait is probably while they authenicate the papers he provided to make sure they aren't forgeries.

Sam which embassy did you interview at, others are worried about needing affidavits of support for their success.

Hehe, don't blame me not to worry. Man just thinking that you have been waiting for this moment for more than 8 months, and now its very close, then you might get denied.... The long wait for this interview is not easy at all, makes you live this dream day by day...

jayo2k, I wish you all good luck!! but man you freaked me out with your posts ! you are the main reason of me stressing a lot... still I love u ! because you did make it taste a lot better when I was accepted... U did make me start thinking of me immigrating to CANADA in one of your post.. I was like fcuk nooooo, I don't want to live in CANADA!!!
