Interview:

Got there at 8:00 am, my interview was 8:30 on Wednesday.

Passed through security check, checked my folder with all documents in it, they asked for the interview letter.
Apparently all sealed documents, they take them and check them alone like (Medical Exam, official transcripts...).
I went in the embassy, another security check, then got to a reception. Person there asks me, please show your interview letter. I did, and was handed a number.
I went in a room full of people with 6 windows, and a room at the end. Window 1-5 were for tourist visa, window 6 was for immigrants, and the door was for interviews with u.s consulate.
I was told once I see someone at window 6 to walk there and give them my number.
Waited for about 30 mins, then I get called by my number.

At the window there was two persons, a guy sitting behind a computer typing everything and a lady asking for my documents.
She had a paper with all the requirements, and was asking me for my documents one by one. on that paper I saw one of the requirements proof of funds... So its needed

Every time I hand one paper she checks it out, ticks on her paper received or not.
She asks for my interview letter first, I passed it under the window.
Asked for medicals, passed the envelop received from my Dr.
Passport with 2 photographs...
Birth certificate, here I passed my individual civil record. Never had a birth certificate before, thought it was my individual civil record.

O:This is not the birth certificate, this is your individual civil record.
Me: I believe that's the document that shows where I was born....
O: Yes, but you were supposed to bring birth certificate
Me: I honestly never had one, or was asked to bring it before, so I thought that its the document I brought with me.
O: it's fine, you can bring it another time, should take you like 5 mins, same place where you ordered your civil document, just ask for birth certificate.
Me: No problem, I will do that today.
O: Individual civil record, Police record, family extract. she checks that they were received.
O: Your proof of education please.
Me: I have my high school diploma, and my associate of applied science when I was in the U.S.
O: please pass both diplomas.
Me: I have my grades from high school, and official transcript from my community college.
O: please if you can pass your transcripts from your college, high school grades not needed.
O: Proof of funds please
Me: I gave her an envelop sealed from my best friend in the U.S. Affidavit of support (I-134 notarized), Tax papers, employment letter, bank letter showing all transaction for the past year..
O: Thanks, please take this paper and if you can go to the entrance again, and go to the windows with cashiers. Please pay $440 and bring the receipt back.

Went all the way out, went back in, paid $440.... Went back in to the same window, and gave the lady the receipts.
O: please sit, and wait for your name to be called.

Its around 10:30 now, and so many people inside. around 11:15 I get called to go at the interview room.

Only one window in that room, and with the u.s consulate.

O:good morning:

O: How are you doing?
Me: I am doing great, thanks. You?
O: good thanks.
O:raise your right hand and swear everything written here is true.
Me: I did
O: Takes my finger prints, Left hand first, then right hand, then both thumbs same time.
O: so you were in the U.S before, what years.
Me: answered
O: What state you are going ?
Me: answered.
O: why?
Me: I lived there for about 4 years, and have a lot of friends, and the person supporting me lives there.
O: I was asked how do you know this person
ME: He's my best friend from when I was studying in the U.S
O: What kind of support, is he going to be willing to provide
ME: My friend will be providing room/Board, and will help me with transportation to go do my job interviews.
O: Do you work now?
ME: Yes, Telecom
O: So you will be working in telecom/ IT in the U.S
ME: Yes, I already have some target job in my mind, when I get in the U.S I will be applying to those jobs.
O: Where did you find those jobs
ME: Monsters.com , I did chose the state where I will be living at my friend's house. (I had printouts of those companies, proving that they are hiring)
O: good, good... Please bring the missing documents any Monday, Wednesday Friday between 2-3 pm with your passport so we can continue processing your visa. and handed me the paper below

It was Wednesday, and Friday is a holiday for eastern so is Monday.. I went straight brought the birth certificate, went and translated it, then went back to the embassy to hand my passport and my document. They took my phone number, and said they will call me once ready.
This is really important info for people having there interviews soon.

I don't get, the response you recieved sad that your visa was denied (unable to issue a visa...) but you said you think you will get it, did i miss something?

They never said it was denied, unable to issue a visa because of missing documents.
If it was was denied I would have had all my documents returned to me, with my passport.

unable to issue the visa means they can't give it to you, unable means can not do, & it says unable due to missing or drop off documents, i advise you to call them, i hope i am wrong

The letter start with "the office regret", why in hell would they regret telling you that your applicaion is accepted?
then they said "unable to issue the visa", that means they can't gve you the visa. & then "the information contained in the paragraph marked with X pertain your visa application. please disregard the unmarked paragraphs.", that means this is the reason for their decision, the paragraph with the "X" mark... I do not want to bust your joy but i do not want you to be in joy to find out that you mistook, from the letter you posted, you got denied,

That was the way they represent the situation when some documents are missing. Since they did not return his passport and stuff, he's good to go.He is under small administration which he had cleared by bring the birth cert.

I was scared when I got the bolded. Sam, which country did you do your interview? Proof of funds is not for Nigerians doing in lagos!
 
so Sam which country you are from, they asked you support document,are in student visa when you are in USA

Sorry if I misunderstand, but wouldn't it be better if they did tick "Further consideration will be given to your visa application after you obtain and present the documents listed above"? Because they should reconsider your visa application in light of receiving your Birth Certificate and actually issue the visa to you. If they are not going to reconsider, doesn't that mean you have been denied and they will not reconsider it, even if you give your missing document (Birth Certificate)?

They way I understood that sentence is that if that was ticked, they would reconsider your denial for a lack of Birth Certificate if you brought your Birth Certificate.

I Hope I have misunderstood and you receive the phone call/email and get your application re-considered and visa approved. The fact that you didn't have all your documents handed back to you indicates that they probably forgot to tick that box, and all you have to do is get hold of your BC and hand it in.

Because they should reconsider your visa application in light of receiving your Birth Certificate and actually issue the visa to you. if they did tick "Further consideration will be given to your visa application after you obtain and present the documents listed above" then it means that it was denied and it needs further consideration. But since my interview was fine, and there was only one missing document for it to be processed, then they need this missing document to finish processing my Visa.

When I was handing all my document at the first window, the officer told me don't worry about it, just bring it another time it takes 5 minutes to get this paper.

Also I believe that if it was denied, they will never ask me to come later on and drop the missing document. Why would they need the missing document, and my passport if my application is denied. from what I understand my case doesn't even need further consideration, just the missing document to be complete.

You do not have any problem. That form is already meant to be given to people in that situation. Not that they will produce a fresh one just to handle your case. Go and drop ur Birth cert and have ur visa. Please which Embassy did you process?

Hello to everyone.

i am new to this forum and I have a question about k3 I had my interview 3
weeks ago and I was denied under section 221 (g) everything was comlpeted with me except my affidavit of support for my I-134 I had them as compies because my wife couldn't send them at the time of my interview so she had to send them via email then she DHL them to me the next day.

and in my interview the consule took my fingerprint and she asked me to raise up my right hand and swear that all the decuments are correct and I swore. she was a very nice cansule then she agve me a white paper saying I was denied under section 221 (g) and asked me to send her my original affidavit of support via Aramex express post office as soon as I get them.

then she said she will do administrative processing on my case in washinghton then she will contact me between 2 to 3 weeks for the next step.

I will type what my denied paper says.

Today I went to the second interview,,,,,, a new CO wanted to restart from the biggining, and she grilled me by the questions... Finally she informed me that I am denied and gave me a paper that explains why :

- Section 221(g) which prohibits the issuance of a visa to anyone whose application does not comply with the provisions of the Immigration and Nationality Act or regulations issued pursuant thereto. The following remarks apply in your case :

being selected to get denied, that suck, very sad, how much did you have in your account?
the tricky thing is that when you are selected, you do not think about applying for the following year DV, so you have to wait 2 years, damn

Wow, they just confirmed my fear. I knew it won't be on the birth cert. So which US Embassy demands Evidence of support in Africa?

What are you planning to do my friend? Why not trying Canada, the funds asked are lower (for quebec is 2,000 CAD & the rest of Canada is 10,000 CAD... Never lose hope, you could still apply for DV 2014 while working & saving money for the interview date if selected

Its not my case that was denied, I am just showing an example of a denied case to prove that mine was not denied and still in process.
 
Temporary Refusal

It is very common for beneficiaries of an immigrant visa petition to have their case temporarily refused under Section 221(g) of the U.S. Immigration and Nationality Act. This usually happens if we need more information in order to make a decision, documents are missing or incorrectly filled out, or further administrative processing is required. If your case is subject to 221(g), you will be given a detailed list of the items that you need to provide. How long it takes to process your case to conclusion will depend on the time it takes you to gather and submit the information and documents needed. Once you have them, call the number on the 221(g) refusal to schedule an appointment.

In some rare cases, further administrative processing of an application is required. We must temporarily refuse the case in these instances under Section 221(g) until processing is complete.

Ineligibility

Immigrant visas may also be refused at the time of interview based on ineligibilities in the law which prohibit issuance of a visa to certain categories of applicants. Some of the more common ineligibilities applicants may face involve unlawful presence in the U.S., deportation, or criminal convictions.

Some ineligibilities result in a permanent bar from entry into the United States. Others can be waived if US Citizenship and Immigration Services approves an application. Whether an applicant can file a waiver application depends on both the type of ineligibility and the relationship between the petitioner and the applicant.

Petitions

A consular officer may return a petition to the Department of Homeland Security (DHS) with a recommendation for refusal or revocation if the officer suspects significant fraud based on discoveries during the interview process. If this occurs, the officer will inform the applicant, then send the petition back to DHS through the National Visa Center. At this point, jurisdiction transfers from U.S. Embassy Belgrade back to the applicable DHS office. Subsequent inquiries about your petition, if you are informed that it has been returned by the Consul, should be directed to DHS.

In a few cases, consular officers can accept a petition for filing at the Embassy. See our Immigrant Visas page for a notice on this subject. DHS has delegated this authority to consular officers in countries where there is no USCIS officers, and it is limited to deciding whether or not an application is "clearly approvable." Authority to deny a petition is only granted to the USCIS office with jurisdiction. Petitions which are found by the consular officer to be "not clearly approvable" will be forwarded to the appropriate USCIS office for final adjudication.

What does a visa denial under INA section 221(g) mean?

A visa denial under section 221(g) of the INA means that the consular officer did not have all of the information required to determine if you are eligible to receive a visa. This means you are not eligible for the visa now, but your case is pending further action for one of the following reasons:

Your application is incomplete and/or further documentation is required - Applicants whose application forms or other documentation are incomplete are refused. If further documents are required to complete your case, you will be informed what is needed and how to provide it to the embassy or consulate. You will also be given a letter stating your application has been denied under 221(g) and listing which documents you need to provide.
Administrative processing - Further administrative processing of your application is required before a decision can be made regarding your eligibility for a visa. You will be given a letter stating this and next-step instructions after the administrative processing is complete.

Is there something I can do about a refusal under section 221(g)?

If your application was denied because documentation or information is missing, you can provide the missing documents or information as soon as possible. After submitting the documentation, your visa application can then be processed to conclusion to determine whether you qualify for a visa. You have one year from the date you were refused a visa to submit the additional information. Otherwise, if you do not provide the required additional information within one year, you must reapply for the visa and pay another application fee.
