EB3, ND 12/00, FP 4/01, moved to local office for interview in 05/01 (SJ)

Please post any information you may have on the expected timeline, ways to get more informationn and rejection rate.

So far I have:

1. Ciba mentions that it takes at least 6 months to get the interview notice and that there is very little information on these cases because people stop posting. Also read Ciba\'s interview related posts.

2. A friend got the notice in 2 months (and got approved) but this was an aging case (kid reaching 21 yrs).

3. Most of the sites list 800 days and more for the whole I485 process at the local center. My guess is that there is very little information on these cases and the number should be taken with a salt.

4. I called the 800 number after hours (800 number mentionned in the AVM), however this is just the main INS number, no direct connection to the local office.

5. What could trigger a rejection and what options are available after that?

6. It looks like some cases are just taken randomingly to ensure the quality of the process.

Me too the same problem. No information as to why the case has been transferred to the local office at San Jose. I don\'t have any information as to when will they schedule my appointment for interview. Is there any way to find out the lastest processing times at the San Jose office

Hi,
my case is in Ciba\'s tracking list ( INS ). I was transfered to LA for interview 3/1/2001.
I called this morning to check the status of my case and to bug them a little... the IIO gave me first that it would take 6 months to get an appointment for my interview, she then check something while putting me on hold and came back retracting herself and now stating that LA is different and that it would take longer : 36 months!
She never wanted to check my personal file/case. She just served me the standard answer and time frame for LA interview transferee.
Good luck to you all. It looks like we are in line for a long wait.
As for the reason why my case was transfered for interview : I have no clue.

Guys

sorry to hear you have been chosen to be interviewd.....dont worry ..all will be ok....I am just wondering if you guys fall under any of these categories..

1) Do u have all PD\'s (older than 1999) ?
2) Have u ever overstayed your visa before for more than 6 months?
3) do u work for a relaively new company and will less employees and who employs more foreign workers than native Americans?
4) Changed visa types quite often like F1 - H1 - H4 - AND then back to H1 etc?

Just askiing cos a friend of mine was pretty sure if u fall under these conditions then u might be interviewd?

I have been working with the same company for 4 yrs. I did change companies 5 months after my H1 beginning. Got H1 outside of US, embassy interview.

Only H1 visa here most of the time. Haven\'t been out of status as far as I know.

This is my second GC application, withdrew the first one to be able to apply RIR LC. Maybe that pissed them off.

Guys, I am \'happy\' to have found you. Maybe we can draft together some letter to senator/congressman if there is no progress in a couple of months.

Yes ProA I think thats the reason for your interview...your second GC application....I know u were not wrong in doing it but CSC gets pissed cos of this..I am pretty sure all interview candidates have "something" different than regular GC applicants and interivews are definately not random..take it easy...u will be ok

to answer debo_nair\'s questions....
1-)PD is 3/98...that;s old enough
2-)never overstayed. I am Canadian on TN visa. No need nor no way to overstay in my case even if I wanted to!
3-) 4000 employes 50% Indians on H1-b the rest is made of American born folks
4-)never changed visa. See number 2.

My case is crystal clear. Cannot be simpler. Maybe that\'s why they want to bug me?
In reference to #3, if that was a factor all my Indian friends would be called for interview. The reality is that only a handful got called for interview in the company. Most are lucky enough to get approved by CSC "on paper".

I just remembered that the first application did not reach the I140 stage, we withdrew it at the LC level. Maybe CSC heard of that or not.

To be honest I don\'t really care what the interview is for. However I cannot put my life on hold for another 3 yrs. Work wise I am happy [guess I am the exception on this board :-)] but
1) 3 yrs is a long time for a company/dept to stay afloat
2) work is not the only thing in life.

We\'ll figure out something.

Is there any way to find out the processing times for Interview at San jose office. I remember having read somewhere that they are processing ND JUne 2000 a month ago. Any one having information on the latest processing times please post

Some other interesting information might be to compare San Jose to San Francisco or other close by offices. I do not mind moving if this will speed-up significatly the process ...

Just want to keep this thread alive by bring it upfront.

Most of the cases transferred to local offices for interviews
are probably selected randomly for "quality control" (whatever
that means). Also, those filed under 245(i) have a higer
chances of being transferred.

Our case was transferred to San Jose office around 09/15/00. We recently received interview notice for Interview on June 22. So it will be just over 8 Months to get the interview. The notice
is standard one.

I do not remember dates very well, but I filed for I-485 in Nov\'99, EB-2. If you need the exact
I\'ll post them tommorrow.

I\'ll post my experience to ciba\'s site (and here) after the interview.

Thanks for the info (really appreciated) and congratulations on the interview schedule.

Now, I heard news that the interview is supposedly based on the ND and not on the transfer time. Hopefully for us they are not processing Nov 99 now and your case was just delayed even more than necessary in CSC :-(

Interview people,

Both Hua Zhang and I have a complex familly situation, at least when observed from the outside. The commonality between our cases is that we have more than one address per familly.

Maybe the INS just wants to make sure that other members of the familly are getting the GC on merit, i.e. there is no pending divorce situation and that the couple does not stick together just for the GC.

Can other people confirm/infirm similar situations in their familly?
