Can anyone comment on my situation:

1. I have an approved H1 (starting from Oct 1).
2. Employer hasn't applied for my change of status.
3. I'm currently on valid H4 status.

Can I travel to India from mid-July to mid-Sep on H4. Also, I am trying to avoid stamping at US Consulate in India.

Your responses would be much appreciated.

smart_guy007,

Thanks for the prompt response. So, there is no need to attend an interview for stamping at US consulate. Right? I just want to make sure once again. May be I am being over cautious :).

Thank you once again!

1 if you have valid H4 Visa stamp you can come back to US before H4 visa stamp expires. you will be admitted on H4 status and will get H4 based I-94 and will not be able to work on H4 status

2 If you have H1B approval notice in hand and if you want to work on H1b then get H1 Visa stamp from consulate and enter on H1b status and you will get I-94 based on H1 Visa stamp
