Intent To Change Jobs - Please Help!!!!!!!!!1

I have my work permit now. I work for company A today. Say I switch to B tommorow. When the time runs out on the work permit in June 2001( EB3 , PD March 2, 1999 485 Reciept March 2000 ) How do I renew it ? To renew the work permit, should my present employer A has to do soemthing ?

As a matter of precaution you should not do it. It all depends on the aggressinve stance you want to take. I would say, smile and bear it the company A until you get the green card. With the market constantly changing, things might change very quickly in the new company. In the company A you at least have some contacts/seniority/roots that might come in handy in hard times.

However, should you still wish to change: The new company does not have to be a part of the renewal process. In the form I-765 they do not ask for current employer.

In case they issue an RFE for EAD and if there is any reference to employer, you may be in soup.

If you change jobs to Company B, and have at least 12 months before you get your I-495 approved, then switch jobs to Company B and have them get you a new I-140 - which if you\'re doing it under RIR, shouldn\'t take more than 6 months. YOu can apply the new I-140 to an I-485 filed initially through Company A.

Another option is to wait 3-4 months at Company A before (I\'m assuming you filed your I-485 2-3 months ago), and then switch jobs. You can take advantage of the 6 month clause of being able to change jobs and companies after 6 months of filing I-485.

HVN- My reciept date is March 23, 2000. More than nine months have passed. I wonder why another I - 140 ? Please explain. Thanks a million for all your inputs.

I have talked to my Lawyer according to him you can change Job as long as you are in same Job category or Industry. AD renwal dose not ask for any emloyer information. According to him you don\'t have to do another I-140 from new employer if you don\'t want to. The exsisting I - 485 will be approved as in my case I changed employer and still doing same Job for 6 yr. My client want to hire me for the same Job so I don\'t think it will be problem for me and I don\'t think it will be problem for anybody as Law as of now says you can change Job after 6 months of Jr 1-485 application as long as you work in same job discription and Industry

There are some lawyers who think that the law applies to people who applied for I 485 after Oct,2000 or 18th ( I forget the date) since that was the day when Clinton signed.

A note similar to that effect can also be seen in murthy.com Chat archives.Well there is no telling.

Does anybody have any idea as to when all this will come clear?

Here are my opinions:
- You do not need current employer\'s support to renew your EAD. You, as an individual get the first EAD as well as renewals based on the fact that you have a 485 pending (which makes you eligible for EAD). Some people go through their company lawyers to get the first EAD as well as renewals. I got first one through attorney and did renewal myself.
- GC is for a future job. As long as your employer can give you a letter saying, he still will have that job opening for you after your your GC is approved, you are fine. At the time some INS officer looks at your file, if he sends an RFE for such a letter, then your employer (the one applied for your GC) should be able to provide one. If not, then you have to make sure you can make use of the new law (if you have completed 6 months blah..blah...) and your NEW employer is going to support you.

I have already read about those opinions by lawyers that it may apply to those applied after 17 etc., That\'s why I warned in my previous mail, you have to make sure it is applicable to you and also your new employer supports it. Whatever the lawyers are saying now is just their opinion not a regulation made by INS.

KiranHedge2, Can you tell me what are the documets needed to renew EAD? INS generally send the card direct to home instead to an attorney, but my address has changed(more than 8 months) and I did not applied for a change of address till now . Do I need to first do a change of address or can I directly give the new address in the application.
