Hi, Folks:

I am now holding valid H-1B visa (just got extended), and I am planning to use my AP for traveling back to China soon and to come back using AP and then keep working on my H-1B visa. Anyone happens to know if it is required to return my I-94 form when I exit the US custom while using AP ?

I'd greatly appreciate any information on required travel documents and sharing your travel experience. Thanks in advance,

You need to surrender your I-94 before departure from US. it does not matter if you use AP or H1 Visa for return, all are supposed to surrender I-94 with airline counter before departure

Hi, thanks,

If I surrendered my I-94 at the custom, does that mean my newly-extended H-1B visa is invalidated ? then when I enter US using AP, will I get a new I-94 ? what will be my status then ? I want to continue to work on my H-1B. Thanks,

---NO

---YES

----- you can be on H1 status if you continue working with same employer who filed/extended your recent H1 from BCIS

if you want enter using AP no visa stamp needed, if you get time better try to get H1 stamp and while you enter show the Visa stamp that is your choice. If my I-140 is still not approved I-will get H1visa stamp and enter

When one reenter US by using AP, Does one still get I-94? If answer is yes, how they decide the expire date?

I94 is issued, expiry date is noted as the AP validity end date or 1 year from the entry date. Does not mean anything though. In this case I94 is used to track entry and exit and not as the status expiry date.

I-94 is used to track exit/enter USA. What if someone with greencard, do they also have I-94 or other form to track their exit/enter ? Does Greencard holder need to fill out I-94 form, maybe a stupid question, but I am not sure about it. Thanks,
